JustBookIt – Terms of Service

1. Acceptance of Terms

By accessing or using JustBookIt's website, mobile applications, products, or services (collectively, the "Services"), you agree to be bound by these Terms of Service (these "Terms"). If you do not agree to these Terms, you must not use the Services.

2. Service Authorization

2.1 General Authorization

By using our Services, you expressly authorize JustBookIt to:

  • Act as your authorized agent in managing your flight reservations after you have booked your own travel elsewhere.
  • Access, monitor, and modify your flight reservations, including retrieving airline confirmation codes and other data required to manage reservations on your behalf.
  • Interface with airline employees, airline systems, and other travel providers on your behalf.
  • Make changes to your reservations as needed or deemed appropriate to secure flight credits, refunds, or other compensation from airlines.
  • Store and use your travel credentials, including any applicable confirmation codes, airline login details (if provided), and contact information.
  • Execute any necessary agreements or documentation required by airlines or travel providers to accomplish the Services.

2.2 Reservation Modifications

You explicitly authorize JustBookIt to:

  • Modify your reservations at any time without prior notification to you.
  • Cancel and rebook tickets if it may result in a price drop credit, refund, or other benefit.
  • Apply for and collect airline credits or refunds.
  • Update seat assignments or preferences if necessary in the course of managing your reservation.
  • Make any other changes consistent with our Services, including verifying your identity or requesting additional information if needed.

2.3 Scope of Authorization

This authorization:

  • Is valid for all current and future flight reservations you share with us.
  • Covers all aspects of your airline reservations, including fare negotiations and ticket reissuance.
  • Extends to all major and regional airlines, subject to the airline's policies.
  • Includes the right to agree to provider terms or disclaimers on your behalf if required to secure flight credits or refunds.

3. Service Operation

3.1 Operation and Discretion

  • Our Services operate through both automated and manual systems to track fare changes and interact with airlines.
  • The timing, frequency, and methods used to secure credits or refunds are at our sole discretion.
  • There is no guarantee of successful modifications or airline acceptance.
  • We are not obligated to notify you before making changes or reaching out to airlines on your behalf.

3.2 User Responsibilities

You are responsible for:

  • Providing accurate and complete reservation details, including confirmation codes, passenger names, flight numbers, and any other required data.
  • Maintaining valid payment methods for any resulting fee charges.
  • Responding promptly if we require additional information to manage your reservation.
  • Reviewing all modifications made or communications we send about your reservation.
  • Complying with airline policies, rules, and deadlines.
  • Monitoring your email or other contact methods for updates from us or the airline.

4. Representations and Warranties

4.1 User Representations

You represent and warrant that:

  • You have the legal authority to grant us the right to manage your reservations.
  • All information provided (including personal data and payment details) is accurate, current, and complete.
  • You understand and accept that airline policies may limit the ability to issue refunds, and that flight credits may be the most common outcome.
  • You are at least 18 years old (or the age of majority in your jurisdiction).

4.2 Service Disclaimers

We make no warranties or guarantees regarding:

  • The availability or amount of flight credits or refunds.
  • The success of airline negotiations or the airline's acceptance of proposed changes.
  • Specific savings, upgrades, or lost opportunities arising from reservation modifications.
  • The uninterrupted operation of our Services or any third-party systems.

5. Limitations of Liability

5.1 Service Limitations

We are not liable for:

  • Airline decisions, policies, or system errors that prevent or limit refunds or credits.
  • Missed or unclaimed fare drops if, for any reason, we are unable to track or act on them.
  • Travel disruptions, involuntary rebookings, or any modifications that result in lost seat assignments, upgraded seats, waitlist priority, or other ancillary travel benefits.
  • Third-party (airline or otherwise) delays, actions, or omissions.
  • Consequential, indirect, or incidental damages, including but not limited to lost opportunities, lost savings, or missed upgrades.

5.2 Modification Without Liability

You acknowledge and agree that JustBookIt may modify your reservation (including cancel/rebook scenarios) without prior notice and is not liable for any unintended side effects, such as loss of elite status perks, seat assignments, or mileage benefits.

5.3 Maximum Liability

Our maximum liability to any user shall not exceed:

  • The total fees paid by that user for the specific service at issue, or
  • One hundred U.S. dollars ($100 USD), whichever is less.

6. User Accounts

6.1 Account Requirements

  • You must provide and maintain accurate contact and payment information.
  • You are responsible for keeping login credentials secure and for all activity under your account.

6.2 Account Termination

We may suspend or terminate your account for:

  • Violation of these Terms.
  • Suspected fraudulent or abusive practices.
  • Payment issues or disputes.
  • Any other reason at our sole discretion.

7. Fees and Payment

7.1 Service Fees

  • A fee of 25% of the total flight credit (or refund) value will be charged and paid by you upon the securement of any flight credit or refund.
  • If a refund is secured instead of a credit, our fee is calculated at 25% of the refund amount.

7.2 Payment Authorization

You authorize JustBookIt to:

  • Store and charge your preferred payment method on file.
  • Process payments only after we've successfully secured a flight credit or refund on your behalf.
  • Collect any owed fees for the service rendered.

8. Intellectual Property

All aspects of our Services, including branding, software, algorithms, and content, are the exclusive property of JustBookIt or our licensors. You may not use, reproduce, distribute, or create derivative works from these assets without our express written consent.

9. Dispute Resolution and Arbitration

9.1 Governing Law

These Terms and any disputes arising from or related to the Services shall be governed by the laws of Delaware, without regard to its conflict of law principles.

9.2 Agreement to Arbitrate

You and JustBookIt agree to settle any dispute, claim, or controversy arising out of or relating to these Terms or the Services through binding arbitration, except that each party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

9.3 Arbitration Rules

The arbitration shall be administered by the American Arbitration Association under its applicable rules. The arbitration shall be heard by a single arbitrator. Each party shall bear its own costs unless otherwise determined by the arbitrator.

9.4 Class Action Waiver

You and JustBookIt agree that any dispute will be handled on an individual basis. Neither party will participate in a class or representative action.

10. Platform Abuse and Account Termination

10.1 Prohibited Activities

You agree not to:

  • Attempt to circumvent or manipulate our Services.
  • Create multiple accounts to exploit additional benefits.
  • Provide false or misleading information.
  • Engage in any activity that interferes with our Service operation.

10.2 Enforcement

We may monitor Service usage, investigate suspicious activity, and take legal action or disclose information to authorities if we find evidence of violations.

10.3 Account Deletion

You may request account deletion by emailing flightrefunder@gmail.com. We will remove your account data in accordance with our data retention policies, provided all ongoing transactions are complete.

11. Communications

11.1 Electronic Communications

By using our Services, you consent to receive electronic communications (e.g., emails, in-app messages) for account notifications, service announcements, and other updates.

11.2 Contact Methods

12. Modifications

We may modify these Terms at any time without prior notice. Changes become effective upon posting on our website. Continued use of the Services indicates your acceptance of the updated Terms.

13. Miscellaneous

13.1 Entire Agreement

These Terms constitute the entire agreement between you and JustBookIt regarding the Services, superseding all prior or contemporaneous oral or written communications.

13.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, that provision will be severed, and the remainder will continue in full force and effect.

13.3 Assignment

We may assign or transfer these Terms or our obligations without restriction. You may not assign any rights or delegate your obligations under these Terms without our prior written consent.

14. Acknowledgment

BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND JUSTBOOKIT.
